e.  Apple and Google are not responsible for addressing any claims by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims arising under consumer protection or privacy law.

f.   If a third party claims the app infringes its intellectual property, Dareit (not Apple or Google) is responsible for the investigation, defense, settlement, and discharge of such claim.

g.   You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

h.  Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

10.  PRIVACY

Your use of the Services is subject to our Privacy Policy, which explains what information we collect and how we use it. Information you provide is handled in accordance with the Privacy Policy.

11.   ACCOUNT SUSPENSION, TERMINATION, AND DELETION

b.  You may delete your account at any time from within the app (Settings > Delete Account) or by emailing support@dareit.com from your registered email address. 12.  DISCLAIMERS

a.   The Services are provided "as is" and "as available." To the maximum extent permitted by law, Dareit disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

b.  Dareit does not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that results obtained will be accurate or reliable.

c.   You access and use the Services voluntarily and at your own risk. Any material downloaded or obtained through the Services is at your own discretion and risk, and you are responsible for any resulting damage to your device or loss of data.

13.  LIMITATION OF LIABILITY AND INDEMNITY

a.   To the maximum extent permitted by law, Dareit and its directors, officers, employees, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits, arising out of or related to your use of, or inability to use, the Services, even if advised of the possibility of such damages.

b.  You agree to indemnify and hold harmless Dareit and its directors, officers, employees, partners, and licensors from any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Services, or your breach of these Terms or of any law or third-party right.

14.  GOVERNING LAW AND DISPUTE RESOLUTION

The seat and venue of arbitration will be Delhi, India, and the proceedings will be conducted in English. The arbitral award will be final and binding.

d.  Nothing in these Terms prevents Dareit from seeking interim or injunctive relief from a court of competent jurisdiction.

15.  CHANGES TO THESE TERMS

Dareit may modify these Terms at any time by posting the updated Terms on the Dareit Platform and updating the "Last Updated" date. Where appropriate, we may also notify you by email or in-app notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

16.  MISCELLANEOUS

a.   If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force.

b.  Dareit's failure to enforce any right or provision is not a waiver of that right or provision.
